According to Scheck, Newfeld, and Dwyer (2000), there have been innumerable individuals wrongly convicted of a crime and sentenced to life imprisonment or to death based upon faulty evidence. The historical development of DNA evidence as a tool in the investigative process during the past 25 years is explained/analyzed, and the role of eyewitness evidence in the wrongful conviction of innocent individuals. This paper culminates in the Anthony Capozzi case study where eyewitness testimony wrongfully imprisoned a man before the advent (...) of DNA technology and which ultimately freed him years after the crime. The methodology used is the examination of journal articles, books, and newspaper articles on the phenomenon of wrongful convictions. (shrink)

A significant number of inmates with mental illness reside within the New York State Department of Corrections (NYSDOCS). New York State has taken the initiative to provide mentally ill inmates with necessary services through a collaboration of the New York State Department of Correctional Services and the New York State Office of Mental Health (NYSOMH). The collaboration results in a mental health delivery system that provides many essential services to mentally ill inmates. This paper focuses on the organization of mental (...) health services within NYSDOCS, best practices, past and current litigation, and staff responsibilities. As the population of mentally ill inmates continues to grow, implications for the Human Services professions of OMH and DOCS needs to continue to address and provide adequate mental health care and resources for this special population. After yeast cells commit to the cell cycle in a process called START, genes required for DNA synthesis are expressed in late G1. Periodicity is mediated by a hexameric sequence, known as a MCB element, present in all DNA synthesis gene promoters. A complex that specifically binds MCBs has been identified. One polypeptide in the MCB complex is Swi6, a transcription factor that together with Swi4 also binds G1 cyclin promoters and participates in a positive feedback loop at START. The (...) finding that Swi6 is directly involved in both START and DNA synthesis gene control suggest a model in which Swi6, activated through its participation in START, serves as the central transcription factor in coordinating late G1 gene expression. This paper relates intentionality, a central feature of human consciousness, with brain functions controlling adaptive action. Mental intentionality, understood as the “aboutness” of mental states, includes two modalities: semantic intentionality, the attribution of meaning to mental states, and projective intentionality, the projection of conscious content into the world. We claim that both modalities are the evolutionary product of self-organized action, and discuss examples of animal behavior that illustrate some stages of this evolution. The adaptive advantages of self-organized action impacted on (...) brain organization, leading to the formation of mammalian brain circuits that incorporate semantic intentionality in their modus operandi. Following the same line of reasoning, we suggest that projective intentionality could be explained as a result of habituation processes referenced to the dynamical interface of the body with the environment. He does not give his prescriptions until he has won the patient's support, and when he has done so, he steadilY aims at producing complete restoration to health by persuading the sufferer in to compliance (Laws 4. 720 b-e, [28]). This passage shows the perennial nature (...) of the problems of treating the patient as a person. It shows as well the historical'depth of philosophical interest in medicine. The history of philosophy includes more reflections upon medical ethics than the casual reader might suspect. Many of these reflections are pertinent to contemporary issues such as abortion and population control. Plato, for example, recommends abortion in cases of incest (Republic 5. 461c); and Aristotle argues for letting seriously deformed children die, while forbidding infanticide as a means of popUlation control, suggesting instead the use of early abortions. 'As to the exposure in rearing of children, let there be a law that no deformed child shall live, but that on the ground of an excess in the number of children... let abortion be procured before sense and life have begun; what mayor may not be lawfully done in these cases depends on the question of life and sensation' (Politics VII, 16,335 b20-26, [4]). A refutation of the doomsday argument is offered. Through a simple thought experiment analysed in Bayesian terms the fallacy is shown to be the assumption that a currently living person represents a random sample from the population of all persons who will ever have existed. A more general version of the counter argument is then given. Previous arguments that purport to answer this concern are also addressed. One result is determining criteria for the applicability of time sampling arguments, i.e., under (...) what conditions can a specific instant in time be regarded as a random sample from a time span. Given this new understanding, the incredible consequences of the doomsday and related arguments evaporate. (shrink)

Two tristichs spoken by Helen in the teikhoskopia are singled out for special attention. These lines can be construed not only as epigrams in the general sense, but more specifically as captions appended to an image of the Achaeans encamped on the plain of Troy. Since Helen's lines to a certain extent correspond (...) to the function and style of catalogic poetry, reading them specifically as captions leads to a more nuanced understanding of both Homeric poetry and Homeric self-reference. By contrasting Helen's “epigrams” with those of Hektor, one can also discern a gender-based differentiation of poetic functions. (shrink)

Chariton’s novel, Chaereas and Callirhoe, is intensely interested not only in the emotional experience of the protagonists but also in the emotional effect the narrative has on readers. Among the many emotions depicted within the text, one stands out for its architectonic function: jealousy. Jealousy articulates the plot and propels it forward. Jealousy is also represented as a fundamentally “readerly” emotion: scenes of reading focus on the potential of written texts to stir jealous emotions. Similarly, scenes of embedded narration focus (...) on the jealous reactions of narratees. The plot achieves closure when Chaereas learns to manage his jealousy as narratee and narrator. His experience, however, has implications also for Chariton and his readers. The text’s representation of jealousy as a narrative and textual force speaks both to the experience of writing in a culture that prizes the imitation of prestigious models and to the experience of reading a text that self-consciously hybridizes those models. The lyric speaker begins by turning his or her will into words, but begins to be a Browningesque speaker when this conversion leads to a turning of the will against words. This inversion, or perversion, of the will against its own expression requires a reader to entertain a complex notion of the relationship between intention and language—or, more accurately, to hold in suspension two competing versions of that relationship. A reader learns not only to conceive interpretation in the simple lyric (...) sense, as a prevailing assertion of the will, but also to conceive any given assertion of the will, any intention given over to articulation in language, as an interpretation and therefore a potential falsification inviting further refinement. The playful competition Browning urges between these two conceptions of intentionality frees meaning to wander somewhere beyond the ken of each lyric speaker, somewhere in the future of lyric utterance. Meaning is to the dramatic lyric what action is to the drama proper; and much as the curious "action in character" of Browning's dramas defers dramatic action and makes room for play, so Browning defers meaning in the lyrics by enlisting the patterning forces of the self-interfering will.1· 1. Marriagelike homosexual relationships expose a division among ethicists following Aquinas. Those emphasizing natural law may call such relationships unnatural; those emphasizing the virtues may approve of relationships fostering love and justice. Natural law, the virtues, and homosexuality all show up in Aquinas's "Commentary on Romans"--untranslated and hardly cited. Romans 1:18 opens a discussion of justice. Verse 20 provides Aquinas's chief warrant for natural law. Verse 26 applies virtue and law to "the vice against nature." But Aquinas's account also depends on (...) Paul as an exemplar of virtue and on Aquinas's high regard for the Bible. Aquinas deploys natural law as a mode of biblical exegesis, not an alternative to it. In the "De potentia", Aquinas considers how to proceed when nature and Scripture seem to conflict. The account does not settle, but rather makes more room for, dispute. (shrink)

Upshot: What von Foerster accomplished in raising the specter of second-order cybernetics now requires experimental design and the heavy lifting of theory to complete his quest for new ways of thinking. Scholte’s “black box theatre” points to research into non-trivial systems as a formal means of grasping living systems.

The unsettling language of blood has been invoked throughout the history of Christianity. But until now there has been no truly sustained treatment of how Christians use blood to think with. Eugene F. Rogers Jr. discusses in his much-anticipated new book the sheer, surprising strangeness of Christian blood-talk, exploring the many and varied ways in which it offers a language where Christians cooperate, sacrifice, grow and disagree. He asks too how it is that blood-talk dominates when other explanations would do, (...) and how blood seeps into places where it seems hardly to belong. Reaching beyond academic disputes, to consider how religious debates fuel civil ones, he shows that it is not only theologians or clergy who engage in blood-talk, but also lawmakers, judges, generals, doctors and voters at large. Religious arguments have significant societal consequences, Rogers contends; and for that reason secular citizens must do their best to understand them. (shrink)
